A Little Known Reason For Brad and Angelina To Take Their Children To Germany

All the blogs are abuzz about Brad Pitt and Angelina Jolie moving their children to Germany while he films a movie. But there is a little known reason that may be behind their move. Germany offers the children constitutional protection under Article 6(which protects the parent child relationship) of the German Constitution.

Princess Caroline of Monaco sued members of the German press for publishing photos of her and a mystery man in a restaurant garden, and for taking photos of her children. The lower courts denied her claim because it held that once a public figure leaves their "doorstep" they lose the right to privacy. But on appeal to the German Federal Supreme Court decided that she had erected a sphere of privacy around herself by seeking a private corner of a public place. But when she and the children were in public they were free to be photographed without permission.

But she kept fighting on the grounds that the German Federal Supreme Court ruling was violating her constitutional rights. The German Federal Constitutional Court said that she did have the right to some expectations to privacy outside of her home, the press still had the right to publish photographs of her in places where there wasn't the expectation of privacy like the streets.

Now here is the part that would be of interest to Brad and Angelina. The Constitutional Court decided that the children of public figures aren't public figures in their own right, unless deliberately thrust into the public eye. The child of a celebrity isn't a celebrity under German law and they don't lose their right to privacy. And the European Court of Human Rights ruled further in her favor. That is why in so many European magazines the faces of the offspring of the famous are blurred in photos.

Sorry if the explanation is kind of muddled but I'm not a lawyer, and I tried to explain the best I could. But the Jolie-Pitt may not qualify for the protection because their parents "deliberately thrusted" them into the public eye by selling their photographs.
