Caylee Anthony Update 19 November
ORANGE COUNTY, FL -- Well known Orlando attorney John Morgan is questioning what he believes is a potential mistake made by Casey Anthony's attorney, Jose Baez.
Legal experts told WFTV-TV that a countersuit filed by Casey Anthony against a woman named Zenaida Gonzalez could result in Casey having to take the stand. They say testimony from that countersuit could be used against Anthony in her criminal case.
Prosecutors say Anthony killed her 3-year-old daughter, Caylee Anthony , and she now faces first degree murder charges. Casey says she is innocent and will stand trial in January.
Gonzalez filed a defamation suit after Casey said she was the babysitter who took Caylee. In her countersuit, Anthony says the defamation claim is frivolous. But that could land Anthony on the witness stand.
Morgan told WFTV he's surprised by the countersuit. "I think they are putting their client in a position they may be sorry later," he said.
Casey Anthony claims Gonzalez is not the person she was referring to.
Morgan disagrees, saying his client is now associated with a kidnapped or murdered child.
Casey's attorney is asking for damages and legal fees. Morgan says there's a deficiency in the request, because it does not state why Casey should get any money.
In a further twist, legal experts told WFTV that the motion by Anthony's attorney is actually a motion to dismiss, and not a countersuit.
Morgan said he's never read anything like it.
It just goes to prove that Jose Baez has no idea what to do. Zenaida's lawyer will more than likely ask Casey where Caylee is. I bet the District Attorney's Office will be front and center. If I were Casey I would be asking for a public defender by now, because if she's depending on Jose Baez for her defense she better be prepping her veins for the lethal injection needle.

The defendant's attorney, Jose Baez, was named among the 83 potential state witnesses. That would make defending her mighty difficult.

It was done in error, said State Attorney's Office spokeswoman Danielle Tavernier. An amended list will be filed later today.
Others included on the list are law-enforcement officials and Anthony's family and friends.
