A federal judge has order
MGA Entertainment to stop making and selling
Bratz dolls. The decision comes after a 4 year court battle between Mattel and
MGA. It seems that
Bratz creator Carter Bryant came up with the concept while working at Mattel.
The jury also awarded Mattel $10 million for copyright
infringement and $90 million dollars for breach of contract.
"It's a pretty sweeping victory," Mattel attorney Michael
Zeller said. "They have no right to use
Bratz for any goods or services at all."
But it is not a victory for the parents of little girls asking Santa for the slutty dolls for Christmas.
MGA will be allowed to keep the dolls on the shelves until the end of the holiday season. After that the company will have to reimburse stores for the cost of the merchandise and the cost of shipping the dolls back.
MGA planned to immediately appeal the judge's injunction, Chief Executive Isaac
Larian said in a written statement late Wednesday.
Larian said the company also intended to ask that the order be stayed until the appeals process is over, so that "we can maintain the over 1,500 people that
MGA employs, and continue to give our consumers a product they desire."
I doubt that this will be the end of the
Bratz dolls. Mattel went after them because Barbie sales are on a skid. I'm sure Mattel and
MGA can work out some profit sharing deal.
And I know what my doll collecting mother will be getting for Christmas.
